By creating an account, joining early access or making a booking, you agree to these Terms and to our Privacy Notice. If you do not agree, please do not use Gig Guru.
1. Who we are
Gig Guru, Gig Pal and Markora are brands of Beat Barn Production Sdn. Bhd. (Registration No. 201901040567 (1349897-T)), a company incorporated in Malaysia (“Gig Guru”, “we”, “us”). You can reach us at [email protected] or +60 12-404 6475.
2. What Gig Guru does
Gig Guru is an online marketplace that connects people and businesses who want to hire (“Clients”) with independent creative workers such as musicians, DJs, performers and event crew (“Talents”).
- Talents are independent and are not employees or agents of Gig Guru. Each gig is a service agreement between the Client and the Talent.
- Gig Guru provides the platform, the written service agreement, payment collection and release, and the deductions required by law. We act as the platform provider under the Gig Workers Act 2025 (Act 872) where it applies.
- We do not guarantee that a Talent will be available, that a Client will book, or the artistic result of any performance.
- Early access: some features described on our website, including online bookings and payments, open in stages. Where a feature is not yet live, these Terms apply to it from the day it opens.
3. Accounts
- You must be 18 or older to hold an account. SOCSO deductions under section 5 apply to Talents who are Malaysian citizens or permanent residents; other Talents must hold any permits the law requires to work in Malaysia. A Talent under 18 may only be listed through an account held by a parent or legal guardian, who accepts these Terms and every booking on the Talent's behalf and must be present or arrange supervision at the gig.
- One person or business, one account. You can switch between talent and hiring roles in the same account.
- Give accurate details and keep them up to date. Keep your login and one-time passwords (OTPs) private. You are responsible for activity on your account.
- Verification. Before a first booking or payout we may ask Talents and individual Clients to verify their identity (for example MyKad or passport), and business Clients to verify their company (for example SSM details). We may refuse or remove an account that cannot be verified.
- Business accounts may add team members as Owner, Approver or Poster. The business is responsible for what its team members do on Gig Guru.
4. Bookings and service agreements
- A Client sends a request or invites a Talent to quote. The Talent sends a quote.
- When both accept, Gig Guru prepares a written service agreement with the gig details: date, time, venue, scope, fee, payment terms, cancellation terms and each side's obligations. Gig Pal can help draft it, but both of you must review it.
- Both sides sign electronically. Electronic signatures are valid under the Electronic Commerce Act 2006.
- A booking is confirmed only when the Client has paid the full agreed fee through Gig Guru. Until then, the Talent's date is not reserved.
- Changes to date, time, scope or fee must be agreed by both sides in Gig Guru so the agreement is updated.
Venue details and contact numbers are shared with the other side once a booking is confirmed. Before that, please talk through Gig Guru chat.
5. Payments, fees and deductions
- Clients pay the agreed fee in advance through Gig Guru's payment provider. Gig Guru does not charge Clients a service fee. Card, bank or wallet charges set by the payment provider are shown before you pay.
- Payments are held by our licensed payment provider or in a separate client-funds account, and are not used for Gig Guru's own operations, until they are released or refunded under these Terms.
- Talents pay a platform commission on each completed gig: 10% of the gig fee, or 5% on the Gig Pro plan.
- SOCSO protection (LINDUNG Kendiri). Under the Gig Workers Act 2025 (Act 872), Talents who earn through Gig Guru are covered by PERKESO's Self-Employment Social Security Scheme (LINDUNG Kendiri, Act 789). For Talents who qualify as gig workers under the Act (Malaysian citizens and permanent residents):
- We register you. Gig Guru registers you with PERKESO and reports your contributions. You do not need to register separately for these deductions. You can check your status on PERKESO's PRIHATIN portal or app.
- 1.25% per completed gig. We deduct 1.25% of the fee for each completed gig and pay it to PERKESO on your behalf. Deductions go towards PERKESO's contribution plan (Plan 1 by default) and continue for as long as PERKESO's rules allow, then stop.
- Cover starts with your first gig and protects you against injury or illness from your gig work, including related travel, as set out by PERKESO.
- Top-ups and upgrades. If your deductions are not enough for your plan, or you want a higher plan, PERKESO may ask you to top up through PRIHATIN. That is between you and PERKESO.
- Other work. If you also work outside platforms, or already contribute to LINDUNG Kendiri, PERKESO's rules decide what else you pay. Deductions through Gig Guru still apply.
- Claims. Claims are made to PERKESO (Form PS2). On request, we provide your booking and payment records as proof of your gig work.
- If PERKESO changes the rate or the way contributions are collected, we will follow its rules and tell you before the change applies. Talents who do not qualify under the Act can contribute to LINDUNG Kendiri voluntarily.
- Payout. We release the Talent's payout within 7 days after the gig is completed, unless a dispute has been raised under section 7. Example: on an RM800 gig, the Talent receives RM710 (RM800 − RM80 commission − RM10 SKSPS), or RM750 on Gig Pro.
- Taxes. Talents are responsible for their own income tax. We issue e-invoices for our commission where required under LHDN's e-invoicing rules. If any tax applies to our fees, it will be shown before you pay.
- EPF i-Saraan. Gig Guru may show information and links about voluntary EPF savings. Saving is optional and is between you and KWSP unless we tell you otherwise.
- All amounts are in Ringgit Malaysia (RM).
6. Cancellation and refunds
The cancellation terms in your signed service agreement apply. If the agreement is silent, these defaults apply:
- Refunds go back to the original payment method, normally within 14 days. The payment provider's own processing time may add to this.
- When a Talent cancels, Gig Pal will suggest replacement Talents if the Client wants them. Repeated late cancellations or no-shows affect a Talent's reliability score and may lead to action under section 12.
- Gig Guru does not take commission on amounts refunded to the Client.
7. Disputes
- If something goes wrong, raise a dispute in Gig Guru within 48 hours after the gig's scheduled end. The payout for that gig is held until the dispute is resolved.
- We will review the agreement, chat history and any evidence from both sides, and aim to propose a fair outcome within 14 days. We are not a court, and our decision on releasing held funds does not stop you from taking other action.
- Talents covered by the Gig Workers Act 2025 can also use the dispute routes under that Act. Consumers may also go to the Tribunal for Consumer Claims Malaysia.
8. Gig Pro and Markora Pro
- Gig Pro is RM69.90 a month and lowers a Talent's commission to 5%. It includes Markora Pro.
- Markora Pro on its own is RM19.90 a month or RM199 a year.
- Subscriptions renew automatically until cancelled. You can cancel anytime; you keep the benefits until the end of the period you paid for. We do not refund part-periods unless the law requires it.
- We will give you at least 30 days' notice before changing a subscription price, and you can cancel before the new price applies.
9. Your content and Markora
- You keep ownership of your music, photos, videos, artwork and other content (“Content”).
- You allow Gig Guru a non-exclusive, royalty-free licence to host, display and share your profile Content on Gig Guru and in Gig Guru's own promotion of the platform, for as long as your Content is on Gig Guru. You can remove Content at any time, except copies kept for legal records.
- Only upload Content you own or have permission to use. We will act on valid notices of copyright infringement sent to [email protected].
- Rights to recordings or photos made at a gig, including whether the Client may use them commercially, are set in the service agreement. If it says nothing, the Client may use them for personal and internal purposes only.
- Markora adds an invisible mark and a fingerprint to your files and creates a dated record. It does not register copyright, does not stop copying, and a mark can be weakened by cropping, resizing or heavy editing. Markora is not affiliated with MyIPO. Markora records may help support a claim, but we cannot promise any outcome.
10. Community guidelines
Gig Guru works when everyone is treated with respect. You must not:
- Harass, threaten, discriminate against or exploit anyone, including on the basis of race, religion, gender, disability or age.
- Post false or misleading information, fake reviews, or Content you do not have the rights to.
- Ask for or accept payment outside Gig Guru for a booking that started on Gig Guru, or share contact details to avoid the platform before a booking is confirmed. This protects both sides: payments made outside Gig Guru are not covered by our payment protection, agreements or SOCSO deductions.
- Offer or request anything illegal, sexual services, or work that puts anyone's safety at risk.
- Scrape, copy or misuse other users' data, or interfere with how Gig Guru works.
Clients are responsible for a safe venue, a clear brief, any venue or local permits needed for the event, and fair treatment of Talents on the day. Talents are responsible for turning up on time, prepared, and with the agreed equipment.
11. Gig Pal (AI)
- Gig Pal is an AI assistant. It can make mistakes. Check important details yourself.
- Gig Pal gives general guidance only. It is not legal, financial or tax advice. You make the final decisions, and humans sign every agreement.
- Matches are ranked on skills, location, budget, availability, reliability and language. We do not rank on race, religion, gender or age. Paid placements are always labelled.
12. Suspension and closing accounts
- We may limit, suspend or close an account that breaks these Terms or the law, or puts others at risk. We will tell you why, unless the law or a safety risk prevents it.
- For Talents covered by the Gig Workers Act 2025, we will not suspend an account for more than 14 days without first carrying out an inquiry and giving you a chance to respond.
- You can appeal any decision by emailing [email protected].
- You can close your account anytime in Settings or by contacting us. Bookings already confirmed, payouts and records we must keep by law are not affected.
13. Liability
- We work hard to keep Gig Guru running safely, but we provide it on an “as available” basis and cannot promise it will always be error-free or uninterrupted.
- Each Talent is responsible for their own services and each Client for their own event and venue. Gig Guru is not responsible for what happens at an event, except where caused by our own negligence.
- To the extent the law allows, our total liability to you for any claim is limited to the greater of the fees you paid to Gig Guru in the 12 months before the claim, or RM500. We are not liable for indirect losses such as lost profits or opportunities.
- Nothing in these Terms limits rights you have under Malaysian law that cannot be excluded, including under the Consumer Protection Act 1999 where it applies, or liability for death or personal injury caused by negligence, or for fraud.
14. General
- Changes. We may update these Terms. For important changes we will tell you at least 14 days before they take effect, by email, WhatsApp or in the app. Bookings already confirmed stay under the Terms that applied when they were made.
- Language. These Terms are in English. If we provide a translation and there is a difference, the English version applies.
- Law. These Terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction.
